Recording and Service Fee Change

On May 16, 2019 the Governor signed Bill H3243. This act amended Section 8-21-310 of the South Carolina Code of Laws as it relates to the schedule of recording fees used in South Carolina. These fees will be effective beginning August 1, 2019.

This will remove the current per page fees used for recordings, and instead create flat fees used to record the majority of documents. This amendment will affect the recording fees of all documents as well. It will also involve the creation of a separate recording fee for any deed relating to a title of interest in a vacation time sharing plan. However, in order to record a document as such the deed must include clear notice on the first page and be titled ‘Vacation Time Sharing Ownership Deed’. If not titled this way the document will be rejected due to not meeting the recording requirements defined in the State Statute.

Due to this amendment the Horry County Register of Deeds schedule of fees has changed. As such we are posting the updated fee schedule as it will exist beginning at 8am on August 1st.

UCC Filings

Amendments to UCC Article 9 are effective July 1, 2013, as a result of S.323 signed into law on June 7, 2013. The changes are a result of the 2010 Amendments to Article 9 from the Uniform Law Commission and adopted by the International Association of Commercial Administrators (IACA) which were to become effective July 1, 2013.

Forms submitted for recording must be dated July 1, 2013. Approved forms can be downloaded from the South Carolina Secretary of State website.
